What constitutes data processing?

The technical operations, processes and procedures performed on an automated or non-automated basis which allow collection, storage, modification, transfer and other actions on personal data.

Information that we collect

The data we request from you are contact data and are the minimum necessary in order for us to communicate with you and to establish a contractual relationship.

Time that we will store your personal data

The personal data that you provide to us in order to maintain the commercial relationship will be stored until the end of the commercial relationship and subsequently for the legally stipulated periods. How to exercise these rights

By contacting SAERCO’s data protection officer by writing to the address established for this purpose: dpd@saerco.comincluding, including a photocopy of your DNI or equivalent identity document, indicating your first and last names, and specifying your request, and including the address for the purpose of notifications, the date and your signature. You may also exercise this right through a duly accredited legal representative.

In the event that you consider that your data are not being processed properly, in addition to the above address, you may contact the national supervisory authority, which is the Spanish Data Protection Agency.

Security and updating of your personal data

SAERCO ensures that your data is processed in a confidential manner and has adopted the technical and organisational measures necessary to prevent loss, improper use, alteration and unauthorised access to such data, with due regard to the state of the art, the nature of the data and the risk analysis conducted.

Users

Access and/or use of the SAERCO site provides the status of USER, who accepts, by such access and/or use, the General Conditions of Use recorded herein. The Conditions shall be applicable independent of the General Contractual Conditions that are mandatory where appropriate.

Use of the site

www.saerco.com provides access to multitude of information, services, programs or data (hereinafter “the content”) on Internet, belonging to SAERCO and to its licensors, to which the USER may have access. The USER undertakes responsibility for use of the site. Said responsibility includes the registration required to access certain services or content.

The USER shall be responsible for providing true, licit information in that registration. As a consequence of that registration, the USER may be provided a password for which he shall be responsible, undertaking to make diligent, confidential use thereof. SAERCO complies with the directives of Organic Act 15/1999 of 13th December on Personal Data Protection, Royal Decree 1720/2007 of 21st December, that approves the Regulations on Development of the Organic Act and other regulations in force from time to time, and ensures correct use and processing of the User’s personal data is guaranteed.

Intellectual and industrial property

SAERCO, itself or as assignee, is the holder of all the intellectual or industrial property rights on its web page, as well as the elements it contains (for illustration, images, sound, audio, video, software or texts; brands or logotypes, colour combinations, structure and design, selection of used materials, computer programs required for operation, access and use, etc.), owned by SAERCO or its licensors.

Guarantee and liability waiver

SAERCO shall not be held liable, in any case, for damages and losses of any nature that may be caused, for the purposes of illustration, by errors or omissions in the content, lack of availability of the site or transmission of viruses or malicious or harmful programs in the content, in spite of having adopted all the technical measures required to avoid it.

Modifications

Right of exclusion

SAERCO reserves the right to refuse or withdraw access to the site and/or services offered without prior notice, at its own initiative or when requested by a third party, for users who breach these General Conditions of Use.

General matters

SAERCO shall pursue breach of these conditions, as well as any improper use of its web site, by taking all the civil and criminal actions to which it may be entitled.

Amendment of these conditions and term

Applicable legislation and jurisdiction

The relation between SAERCO and the USER shall be governed by the Spanish laws in force and any dispute shall be submitted to the Courts and Tribunals of Madrid.
